Terms of Service

These Terms of Service ("Terms") govern your use of the Expresstimates website (expresstimates.com) and the inspection-analysis report service (the "Service") provided by Zagwa LLC (d/b/a Expresstimates) ("we", "us", "our"). By purchasing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.

2. What the Service is

You provide a property address, your email, an uploaded home-inspection report (PDF), and optionally a listing description. We analyze that material together with public records and produce a written report containing itemized repair-cost estimates, cited building/housing codes, potential penalty exposure, property records, and a suggested fair-price range. A human reviews each report before it is sent. We aim to deliver the report within 24 hours of payment; this turnaround is a target, not a guarantee.

3. Not professional advice

The Service produces good-faith estimates for informational purposes only. It is not a home inspection, appraisal, contractor bid, legal advice, or a substitute for a licensed contractor, appraiser, engineer, or attorney. Repair costs, code citations, penalty figures, and valuations are estimates derived from your materials, public records, and automated analysis, and may contain errors. Do not rely on the report as the sole basis for any purchase, financing, rental, repair, or legal decision; independently verify anything material to you.

4. Price & payment

The Service is offered for a flat fee of US $99 per report unless otherwise stated at checkout. Payment is processed by Stripe; we do not receive or store your full card details. You authorize the charge when you complete checkout.

5. Refunds

Because each report consumes computing and data costs as soon as work begins, all sales are final once we start preparing your report. However, if we decline your order or are unable to produce a usable report (for example, the uploaded PDF is unreadable or insufficient), we will issue a full refund. If you believe there is a problem with your report, contact us and we will work in good faith to make it right.

6. Your responsibilities

• You confirm you have the right to upload the inspection report and any listing text you submit, and to have us process them.
• You agree the information you provide (address, email) is accurate.
• The uploaded PDF may contain personal information of third parties (e.g. an inspector's name/license or an occupant's name). You are responsible for redacting any sensitive personal information you do not want processed before uploading. See our Privacy Policy for how data is handled.

7. Acceptable use

You agree not to use the Service to upload unlawful content or content you lack rights to, to attempt to disrupt or reverse-engineer the Service, to resell the Service as your own, or to use it in violation of any law. We may suspend access for misuse.

8. Third-party & AI processing

To produce your report we share the materials you submit with third-party service providers, including AI/large-language-model providers and real-estate data providers, as described in our Privacy Policy. By using the Service you consent to this processing. Outputs are generated in part by automated systems and are reviewed by a human before delivery, but we cannot guarantee they are complete or error-free.

9. Intellectual property

You retain ownership of the materials you upload. You grant us a limited license to use, store, and process those materials to provide the Service. Once delivered and paid for, the finished report is yours to use for your own purposes. We retain ownership of our software, templates, and methods, and may retain and use de-identified or aggregated data to operate and improve the Service.

10. Disclaimers of warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the report will be accurate, complete, or suitable for any particular decision.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid for the report giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost savings, or amounts based on a property transaction, even if advised of the possibility. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Zagwa LLC (d/b/a Expresstimates) from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right (including uploading materials you lacked the right to submit).

13. Our right to decline

We may decline or cancel any order at our discretion (for example, unreadable materials, suspected misuse, or out-of-scope requests) and will refund any payment for an order we decline.

14. Changes to the Service or Terms

We may update the Service or these Terms from time to time. Material changes will be posted here with a new effective date; continued use after changes means you accept them.

15. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, seated in Fort Bend County, Texas or conducted remotely. You and we waive any right to a jury trial and to bring or participate in a class or representative action, to the extent permitted by law. Either party may instead bring an individual claim in small-claims court if it qualifies.
